Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and NoSiteSearch ("No-Site Search," "we," "us," or "our"), and they govern your access to and use of No-Site Search and the application at https://app.nositesearch.com (collectively, the "Service"). Please read them carefully.

1. Acceptance of terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. You must be at least 18 years old to use the Service.

2. Description of the Service

The Service provides:

• Lead discovery — searching public sources to find local businesses (including those without a website) and returning outreach-ready contact details such as name, category, address, and phone number.
• AI website generation — generating website content and layouts for a business using AI.
• Hosting — hosting the websites you generate so they can be served to visitors.

We may add, change, or discontinue features at any time. We aim to keep the Service available but do not guarantee uninterrupted access.

3. Accounts and your responsibilities

• You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You must notify us promptly of any unauthorized use of your account.
• You may delete your account at any time from the account settings in the app.

4. Acceptable use

You agree that you will not:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Use data obtained through the Service for illegal scraping, spam, or harassment.
• Send marketing or outreach communications without complying with all laws that apply to you, including the CAN-SPAM Act, the Telephone Consumer Protection Act, the GDPR, the ePrivacy rules, and similar laws. You are solely responsible for the legality of your own outreach, including obtaining any required consent and honoring opt-out requests.
• Resell, sublicense, or redistribute the raw data or the Service in a way that competes with us, except as expressly permitted.
• Attempt to gain unauthorized access to the Service, interfere with its operation, circumvent rate limits, or reverse engineer it.
• Use the Service to generate or host content that is unlawful, fraudulent, deceptive, infringing, or harmful.

We may suspend or terminate accounts that violate this section.

5. Credits, subscriptions, and billing

• Billing model. The Service operates on a credit system. You obtain credits through a recurring subscription plan and may purchase additional top-up credits as needed.
• Credit costs. One search consumes one credit, and generating one AI website consumes three credits. Credit costs may change for future purchases; any change will be reflected before you buy.
• Free trial credits. New accounts may receive trial credits so you can try the Service. Trial credits have no cash value and may expire or be modified at our discretion.
• Subscriptions. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current period.
• Payments. Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for the plan and any top-up purchases you make.
• Refunds. Except as set out in our Refund Policy, payments and consumed credits are non-refundable.

6. Intellectual property

• Your content and generated sites. As between you and us, websites and content you generate using the Service belong to you. You are responsible for ensuring you have the rights to any materials you provide and that your generated sites comply with applicable law.
• Platform badge. Websites hosted on our free hosting tier may display a No-Site Search badge or attribution. Removing the badge may require a paid plan.
• Our property. The Service itself, including its software, design, and trademarks, remains our property and that of our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

7. Third-party data disclaimer

Business contact data is compiled from publicly available sources and is provided on an "as is" basis. We do not warrant that it is accurate, complete, current, or fit for any particular purpose. You are responsible for verifying data before relying on it and for using it lawfully. The Service also relies on third-party providers, and we are not responsible for their acts or omissions.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that results obtained from it will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, No-Site Search and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim or one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless No-Site Search from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your outreach activities, your content, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends, and provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree to submit to the exclusive jurisdiction of the courts located in the State of Delaware, United States to resolve any dispute arising out of these Terms or the Service.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
